Appeals Court Rules Obamacare Is Unconstitutional

By Jeremy Pelofsky and James Vicini

President Barack Obama’s signature healthcare law suffered a setback on Friday when an appeals court ruled that it was unconstitutional to require all Americans to buy insurance or face a penalty.

The U.S. Appeals Court for the 11th Circuit, based in Atlanta, ruled 2 to 1 that Congress exceeded its authority by requiring Americans to buy coverage, but it unanimously reversed a lower court decision that threw out the entire law.

Americans spend twice as much as residents of other developed countries on healthcare, but get lower quality, less efficiency and have the least equitable system, according to a report released on Wednesday.

The United States ranked last when compared to six other countries — Britain, Canada, Germany, Netherlands, Australia and New Zealand, the Commonwealth Fund report found.

The land of national health care

An ambulance from Britain's National Health Service (Graham Richardson)

By Mike Marqusee

DURING THE three years I’ve been in treatment at Barts for multiple myeloma, I’ve given thanks many times to Britain’s National Health Service (NHS) and the people who built and sustain it. Since I grew up in the United States and still have close friends and family there, I’m acutely aware of how different things might have been.

Contracting a serious illness anywhere is occasion for anxiety and uncertainty. But in the U.S., anxiety and uncertainty are multiplied many times over. People who only know the NHS may not realize what they’re being spared.

Last month, President Barack Obama bemoaned double-digit increases in healthcare premiums — most notably a 39% year-over-year hike by the Blue Cross insurance leviathan Wellpoint in California. Wellpoint is raising premiums by double digits for many customers in 11 states.

But according to an analysis by the Associated Press, health insurance premiums will rise under the Democrats’ own health care plan championed by President Obama.

By Michael Collins

Time Magazine’s Joe Klein is having an allergic reaction to free speech and public debate. The title of his latest column says it all:   The Left’s Idiocy on Health Reform. It’s an ex cathedra pronouncement from a made man at one of the nation’s oldest media properties.

What’s got Joe so worked up?

Another Historic Bailout: Health Insurance Industry Defeats Public Will, Public Health

By Rady Ananda

The Patient Protection and Affordable Care Act passed the Senate on Christmas Eve, forever memorializing President Obama’s squeeze on tens of millions of poor Americans. In perfect Scrooge fashion, the bill mandates those who cannot afford health insurance to buy it.

The insurance industry exists solely on profits garnered by denying claims. A majority of US citizens rebuked the middleman plan, but Obama and the Democrats pushed to support another industry bailout at the expense of the public. Talk about class war.

The business of health care reform

ISR Editorial

MOST GREAT American fortunes were made by capitalists who used the power of government to gain advantages over competitors or to profit from public resources. For example, the Gilded Age plutocrats—the Vanderbilts, the Astors, the Stewarts, the Goulds—built their railroad-based fortunes on the foundation of $100 million in federal and state grants and 200 million acres of federal land grants.
